In a decision released September 1, 2010, Turk wrote that “the irrationality of OP 803.2 stems from the fact that it encompasses much of the world's finest literature, but does not extend to 'soft core' pornography such as Playboy magazine.” Turk ruled that the regulation was unconstitutional, struck it, and gave the DOC 60 days to draft new, legally sound regulations.
